QA1 MINIMUM ADVERTISED PRICE POLICY, EFFECTIVE DATE MAY 1, 2019
QA1 Precision Products, Inc. (“QA1”) is committed to providing high-quality products at an affordable price for our customers. We are committed to ensuring that all customers receive the highest level of service and support, and we will only sell to resellers who are equally committed to the QA1 brand. Therefore, QA1 has adopted a Minimum Advertised Price (MAP) Policy on products it identifies as “Covered Products.” This MAP Policy is designed to support and protect the QA1 brand reputation, integrity, value, and success, which benefits all resellers of our products.
This MAP Policy covers all resellers of QA1 products located in the United States, and it applies only to the Covered Products listed in the price file. The MAP will be included in the price file from this date forward and will be updated on occasion.
THIS POLICY IS NOT INTENDED TO CONTROL OR LIMIT THE PRICE AT WHICH ANY RESELLER MAY SELL. THIS POLICY IS STRICTLY LIMITED TO RESTRICTIONS ON ADVERTISING. EACH RESELLER REMAINS COMPLETELY FREE TO DETERMINE ITS OWN RESALE PRICE FOR ALL PRODUCTS. NO EMPLOYEE OR AGENT OF QA1 IS AUTHORIZED TO SUGGEST ANYTHING TO THE CONTRARY.
Advertising to which this Policy Applies
For the purpose of this Policy, “advertising” includes, but is not limited to, any and all announcements, communications, information, or publications generated, developed, produced or distributed by or on behalf of any type of reseller in any format or media, including by way of example only: print (including
without limitation, newspapers, inserts, catalogs, fliers, letters, circulars, and magazines); television; cable; radio; billboards; e-mail; text messaging; faxes, signs; electronic media; internet websites (including without limitation, any website owned or operated by or on behalf of a reseller or its affiliate, third-party websites, banner advertisements, and pages that follow banner advertising upon a “click-through”), Facebook, Craigslist, Instagram, Pinterest, Twitter, or other social media sites.
QA1 is not responsible for errors or omissions made on behalf of e-commerce vendors, online retailers (i.e., eBay, Amazon, etc.), or other third parties, or the capabilities of such parties. Resellers are solely responsible and advised to check the Policy to ensure the advertising is MAP compliant.
Terms of Minimum Advertised Price Policy
For any advertisement in which a reseller uses QA1’s trademarks and/or advertises any new and current Covered Product, the advertised price may not be less than the current listed MAP, as published and updated from time to time by QA1, unless expressly permitted in writing by QA1. QA1 will provide a minimum of 30 days notice on updates to MAP.
Violations of MAP Policy
All of the following violate this Policy:
- Any advertising that shows or implies a price lower than the MAP or that has the effect of reducing the advertised price below the MAP (this includes “See Price in Cart,” “Click for Best Price,” and other verbiage that would imply or lead to a price lower than MAP);
- Any advertisement that includes discounts, rebates, products, coupons, or other offers that serve to reduce the advertised price below the MAP, whether this reduction is stated in terms of a specific dollar amount or more generally as a reduction, such as, but not limited to “10% off List price,” “get a free XXX with purchase of XXX,” “Price Slashed,” “Blowout Prices.” This includes “We’ll Pay Tax” offers;
- Any “strike-through” or other alteration to the MAP is prohibited.
This Policy does NOT apply to the following:
- In-store advertising, in-store displays, in-store banners, or in-store price markings within a reseller’s store or on the exterior of the dealership facility and surrounding parking lot; • QA1-sponsored promotions or programs;
- Store-wide discounts on all store or site items, so long as such promotions are for a limited time and QA1 products are not separately identified;
- E-mails, text messages, letters, and quotes addressed to an individual customer (but not mass emails or other mass blasts) in connection with that customer’s inquiries, specific expressions of interest, or its specific business with the reseller;
- Free or reduced shipping;
- Advertising without any reference to price.
Enforcement and Non-Compliance
Non-compliance of the MAP guidelines set forth in this Policy will result in penalties of increasing severity issued by QA1. Resellers who advertise Covered Products below the defined MAP will be notified via written warning of the violation. If the violation isn’t immediately remedied or the company has additional violations, QA1 may take additional actions at its sole discretion, up to and including suspension and/or cancellation of orders, placement on a “Do Not Sell” list, and/or termination of the reseller’s account. In the event of termination, all use of QA1’s trademarks, product names, and images will be prohibited.

Compliance with this Policy is the responsibility of each individual reseller. Any questions must be directed to MAPadmin@QA1.net. QA1 sales and support representatives are not authorized to discuss or answer questions about the enforcement and/or non-compliance (or lack thereof) of any reseller.
